These Terms of Service ("Terms") govern your use of AI UGC Creator, a mobile application that provides AI-powered video generation services ("Service") operated by Byveya ("we", "us", or "our").

Acceptance of Terms

By downloading, installing, or using AI UGC Creator, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

Description of Service

AI UGC Creator is a mobile application that allows users to generate AI videos using text prompts and optional reference images through integration with our AI video generation service.

Free Tier

  • Generate up to 1 video per day
  • Generate up to 4 videos per week
  • Access to basic video generation features
  • Standard processing priority
  • Content Ownership: Byveya retains ownership of generated content (see Intellectual Property section)

Pro Tier

  • Pricing: £19/month (Monthly) | £15.20/month (Annual - £182.40/year)
  • Generate up to 10 videos per day
  • Generate up to 70 videos per week
  • Priority processing
  • Advanced features access
  • Content Ownership: You retain ownership of generated content

Premium Tier

  • Pricing: £49/month (Monthly) | £39.20/month (Annual - £470.40/year)
  • Generate up to 50 videos per day
  • Generate up to 350 videos per week
  • Fastest priority processing
  • All premium features including API access and custom branding
  • Content Ownership: You retain ownership of generated content

Business Tier

  • Pricing: £79/month (Monthly) | £63.20/month (Annual - £758.40/year)
  • Generate up to 100 videos per day
  • Generate up to 700 videos per week
  • Fastest priority processing
  • All premium features plus team collaboration and dedicated account manager
  • Content Ownership: You retain ownership of generated content

User Accounts

Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to use our Service

Account Responsibilities

  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

Acceptable Use

Permitted Use

  • Generate videos for personal, commercial, or professional use
  • Share generated videos on social media platforms
  • Use videos in content creation and marketing materials

Prohibited Activities

  • Generate content that violates laws or regulations
  • Create videos depicting illegal activities, violence, or harm
  • Generate misleading or deceptive content
  • Attempt to reverse engineer or copy our Service
  • Use automated tools to bypass usage limits
  • Share account credentials with others
  • Generate content that infringes on intellectual property rights
  • Create content that harasses, threatens, or discriminates against others
  • Generate explicit, pornographic, or inappropriate content

Content Guidelines

  • Respect the rights and dignity of all individuals
  • Do not use the Service to create content that could be harmful or offensive
  • Ensure all generated content complies with applicable laws and regulations

Intellectual Property

Content Ownership for Free Tier Users

Important: For users on the Free tier, Byveya retains ownership of all AI-generated content created through the Service

  • Byveya reserves the right to use, promote, and share this content publicly across all platforms (digital and physical) for marketing, promotional, and business development purposes
  • You may use generated content for personal purposes but do not own it
  • Byveya may display, distribute, or otherwise use generated content in portfolios, marketing materials, or other promotional contexts

Content Ownership for Paid Tier Users

  • For Pro, Premium, and Business tier users, you retain ownership of AI-generated content created through the Service
  • You may use, modify, and distribute your generated content as you see fit
  • You retain ownership of any reference images you upload

Our Intellectual Property Rights

  • AI UGC Creator and its original content are protected by copyright and other intellectual property laws
  • We retain rights to our algorithms, interfaces, and underlying technology
  • The Service name, logos, and branding are our exclusive property

Data Collection and Usage

Information We Collect

  • Personal information: Email, name, and account preferences
  • Usage data: Video generation history, prompts, and interaction patterns
  • Device information: App version, device type, and performance metrics
  • Content data: Text prompts and reference images used for video generation

How We Use Your Data

  • To provide and improve our AI video generation services
  • To enforce usage limits and manage subscriptions
  • To analyze service performance and identify improvements
  • To communicate with you about your account and our services
  • To comply with legal obligations and protect our rights

Payment Terms

Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • Annual subscriptions receive a 20% discount compared to monthly billing
  • Payment is processed securely through Stripe
  • All fees are non-refundable except as required by law
  • Prices are displayed in British Pounds (£) and may be subject to change with 30 days advance notice

Subscription Management

  • You may upgrade, downgrade, or cancel your subscription at any time
  • Changes take effect at the next billing cycle
  • We may change pricing with 30 days advance notice

Failed Payments

  • If payment fails, your account may be suspended
  • You will be notified and given time to update payment information
  • Repeated failed payments may result in account termination

Usage Limits and Fair Use

Daily and Weekly Limits

  • Free tier: 1 video per day, 4 videos per week
  • Pro tier: 10 videos per day, 70 videos per week
  • Premium tier: 50 videos per day, 350 videos per week
  • Business tier: 100 videos per day, 700 videos per week

Credit Packs

  • Credit packs provide additional video generation credits without a subscription
  • Small Pack: £4.99 for 5 video credits
  • Large Pack: £9.99 for 12 video credits
  • Credits never expire and are used before daily subscription limits
  • Credits can be purchased independently or alongside any subscription tier
  • Credit pack purchases are one-time payments and non-refundable

Student Discounts

  • Verified students are eligible for a 50% discount on all subscription tiers
  • Student verification requires uploading a valid student ID document
  • Verification typically takes 24-48 hours for review
  • Discount is automatically applied at checkout for verified students
  • Student discount applies to both monthly and annual billing periods
  • Discount persists for the lifetime of the subscription while student status remains verified
  • Student discounts are not applicable to credit pack purchases

Fair Use Policy

  • Usage limits are intended to prevent abuse and ensure service availability
  • We reserve the right to limit usage that appears automated or excessive
  • Commercial users should consider upgrading to appropriate tiers

Service Availability

Uptime

  • We strive for 99.5% uptime but do not guarantee uninterrupted service
  • Maintenance windows may be scheduled with advance notice
  • Service outages may occur due to factors beyond our control

Service Changes

  • We may modify or discontinue features with reasonable notice
  • We will make reasonable efforts to minimize disruption
  • Critical security updates may be deployed without notice

Disclaimers and Limitations

AI Content

  • AI-generated content may not always meet expectations or be factually accurate
  • We do not guarantee the quality, accuracy, or suitability of generated videos
  • Generated content should be reviewed before use in any context
  • You are responsible for ensuring generated content meets your needs

Third-Party Services

  • Our Service integrates with OpenAI's AI video generation services and other third-party services
  • We are not responsible for third-party service availability, changes, or terms
  • Your use of third-party services is subject to their respective terms

No Warranties

  • Service is provided "as is" without warranties of any kind
  • We disclaim all implied warranties including merchantability, fitness for purpose, and non-infringement
  • We do not warrant that the service will meet your specific requirements or be uninterrupted

Limitation of Liability

  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not liable for loss of data, business interruption, lost profits, or any other damages
  • This limitation applies even if we have been advised of the possibility of such damages

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your violation of these Terms or applicable laws
  • Your use of the Service or generated content
  • Content you generate, distribute, or use
  • Your infringement of third-party rights
  • Any misrepresentation or breach of your obligations

Account Deletion and Data Removal

Your Right to Deletion

You can request complete deletion of your account and associated data by:

  1. Going to Account Settings in the app
  2. Selecting "Delete Account"
  3. Confirming your request through email verification

What Gets Deleted

  • Your account and profile information
  • Generated content (subject to content ownership terms above)
  • Usage history and preferences
  • Any other data associated with your account

Retention for Legal Compliance

We may retain certain information as required by law, for legal compliance, or to protect our rights, even after account deletion.

Termination

By You

  • You may terminate your account at any time through the app settings
  • Termination does not relieve you of payment obligations for active subscriptions
  • Generated content ownership follows the terms outlined in the Intellectual Property section

By Us

  • We may terminate or suspend your account for violations of these Terms
  • We may terminate service with 30 days notice for non-payment
  • We reserve the right to terminate service at any time for any reason

Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be resolved in the courts of England and Wales.

Changes to Terms

We may modify these Terms at any time. Changes will be effective 30 days after posting unless:

  • Material changes require your explicit consent
  • Changes are required by law
  • You will be notified of significant changes through the app or email
